“You”, “Customer” refers to any user or purchaser of our services
“Service” refers to AI-assisted portrait creation
“Digital Products” refers to all image files and deliverables provided
3. Nature of Service (AI + Human Directed)
Luxury AI Portraits provides custom digital portrait images created using artificial intelligence and directed, reviewed, and quality-checked by human professionals.
This is not a fully automated bot-only service. Each order involves human oversight to ensure careful delivery and quality control.
4. Customer Supplied Assets & Quality Disclaimer
The quality of the final images depends directly on the quality of the images supplied by the customer.
By placing an order, you acknowledge that:
Lighting, clarity, angles, facial visibility, and image resolution impact results
Low-quality, filtered, obstructed, or misleading images may limit outcomes
Exact likeness, symmetry, or specific facial features cannot be guaranteed
Luxury AI Portraits is not responsible for outcomes impacted by unsuitable or poor-quality images supplied by the customer.
5. Delivery of Digital Products
All products are delivered digitally.
Estimated delivery timeframe: within 5 business days from receipt of all required assets
Business days are Monday to Friday, 9:00am to 5:00pm AEDT, excluding public holidays
Delays may occur if required information or images are not supplied promptly
Delivery is deemed complete once digital files are sent to the email address provided at checkout.
6. Revisions & Alterations Policy
Each order includes one (1) alteration only.
Alteration requests must be submitted within two (2) business days of delivery
Requests outside this timeframe may be declined
Additional revisions are not guaranteed and may incur additional fees
Requests exceeding the original scope of the order may be refused.
7. Digital Products & Refund Policy
Luxury AI Portraits provides custom, made-to-order digital products.
Once work has commenced, refunds are not available, except where required under Australian Consumer Law.
By purchasing, you acknowledge that:
You are ordering a personalised digital service
Change of mind does not constitute grounds for a refund
Minor dissatisfaction does not guarantee a refund where services were delivered as described
8. Commercial Usage Rights
Upon full payment, you are granted a non-exclusive, worldwide, perpetual licence to use the final delivered images for personal and commercial purposes, including marketing, advertising, websites, and social media.
Luxury AI Portraits retains ownership of all systems, workflows, and AI processes used to create the images.
We may display anonymised or consented images for portfolio or promotional purposes unless you notify us in writing prior to delivery.
9. Intellectual Property
Unless otherwise stated, all website content, branding, text, systems, and processes are owned by ALESMARC PTY LTD.
You must not:
Copy or republish website material
Sell, rent, or sub-license website content
Redistribute content without written permission
10. Customer Authorisation & Consent
By submitting images and placing an order with Luxury AI Portraits, you expressly authorise ALESMARC PTY LTD to:
Use, process, modify, and transform the images you provide
Generate AI-assisted portrait images representing your likeness
Produce digital images on your behalf based on the preferences, style, and direction you supply
You confirm that:
You are the individual depicted in the images, or you have full authority and consent from the individual depicted
You understand and consent to the use of artificial intelligence and human-directed processes
You grant permission for Luxury AI Portraits to create, refine, and deliver images in accordance with your order
This authorisation is granted solely for the purpose of fulfilling your purchase and delivering the agreed services.
You acknowledge that AI-generated images are artistic interpretations and that outcomes may vary.
11. Customer Representations & Warranties
You warrant that:
You have legal rights to upload all images supplied
Uploaded images do not infringe copyright, privacy, or third-party rights
Uploaded materials are lawful and not defamatory or misleading
You indemnify ALESMARC PTY LTD against any claims arising from materials you provide.
12. AI-Generated Content Disclaimer
Images produced by Luxury AI Portraits are AI-generated artistic representations.
We do not guarantee:
Exact facial replication
Identical likeness to real photographs
Outcomes beyond reasonable artistic interpretation
Results may vary between individuals and orders.
13. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential loss
Liability is limited to the amount paid for the service
We are not responsible for downstream or third-party use of images
Nothing in these Terms excludes rights under Australian Consumer Law.
